Terms and Conditions of the FavPaw Online Store Effective from: 01.12.2024

I. General Provisions These terms and conditions define the rules for using the online store available at favpaw.pl, operated by Win IT Emil Winiarczyk, with its registered office in Kraków at ul. Kobierzyńska 164B, entered into the Central Registration and Information on Business (CEIDG), NIP: 5641759684, REGON: 384647669.

The online store conducts retail sales of accessories and gadgets for pets, clothing and accessories for their owners, and may offer products in the form of digital content.

These terms and conditions are an integral part of the sales contract concluded with the Customer.

The condition for placing an order in the store is the Customer's acceptance of these terms and conditions.

II. Definitions Customer – a natural person with full legal capacity, a legal entity, or an organizational unit without legal personality but with legal capacity, placing an order in the Store.

Consumer – a Customer who is a natural person purchasing goods for purposes not directly related to their business or professional activity.

Store – the online store operating atwww.favpaw.pl.

Goods – products available in the Store, which are the subject of the sales contract.

Digital Content – products in electronic formats, such as e-books, webinars, or other multimedia files available for download.

Terms and Conditions – these terms and conditions of the Store.

III. Order Placement Rules Orders can be placed via the Store's website.

When placing an order, the Customer selects the Goods, their quantity, and the delivery and payment method.

An order is considered placed when confirmed by the Customer with the "Order and Pay" button.

The Customer receives order confirmation via email.

Order processing begins after the payment is credited to FavPaw's account.

In the case of personalized products, the Customer provides personalization details in the appropriate field of the Order Form.

IV. Prices and Payment Methods All prices listed on the Store's website are gross prices (including VAT) and are expressed in Polish złoty (PLN).

A receipt or electronic VAT invoice is issued for each order, depending on the Customer's choice.

The Customer can choose the following payment methods:

• Traditional bank transfer

• Online transfer (electronic payments)

In the event of withdrawal from the contract, the payment refund is made using the same method chosen by the Customer at the time of purchase, unless the parties agree otherwise.

V. Delivery Delivery of goods is carried out within Poland via InPost. Shipping is carried out on behalf of the Customer.

The delivery cost is borne by the Customer unless the promotional offer states otherwise.

The order fulfillment time depends on the type of product and is individually arranged with the Customer. Ordered products should be delivered to the Customer within 30 days unless a longer fulfillment time is indicated in the product description. In such a case, placing an order means the Customer agrees to the longer fulfillment time resulting from the product description. In the event of the inability to fulfill the order within the specified time, the Customer will be informed and will have the option to cancel the order or choose another delivery date.

If the order includes products with different fulfillment times, the delivery time for the entire order is the longest fulfillment time among the selected products. However, the seller may propose splitting the order into several shipments, allowing for earlier delivery of some products.

Upon receiving the delivered shipment, the Customer is obliged to check its technical and physical condition. In case of damage to the shipment, it is recommended to draw up a damage report in the presence of the courier and notify FavPaw about it. The damage report is helpful in the complaint procedure, and its absence may hinder the Customer's claims and determine the person responsible for the damage. Complaints regarding damage occurred during shipment made by a Customer who is not a Consumer will not be considered without an attached damage report.

VI. Right of Withdrawal A Customer who is a Consumer has the right to withdraw from the sales contract within 14 days of receiving the goods without giving any reason.

The right of withdrawal does not apply to contracts regarding non-prefabricated items, produced according to the Customer's specifications or serving their individualized needs, such as customized or personalized products.

To exercise the right of withdrawal, the Customer must inform the Store of their decision by a clear statement sent to the email address: kontakt@favpaw.pl

The Customer bears the direct costs of returning the goods to the Store.

A refund will be made within 14 days of receiving the returned goods by the Store.

When sending the withdrawal statement by traditional means (post, courier), the 14-day withdrawal period is counted from the date of dispatch of the correspondence.

In the event of withdrawal from the contract, the contract is considered not concluded.

VII. Complaints and Guarantees The Store undertakes to deliver goods free from defects.

In case of finding a defect in the purchased goods, the Customer has the right to lodge a complaint within 2 years from the date of purchase.

Complaints should be submitted via email to kontakt@favpaw.pl or by post to the Store's address: ul. Kobierzyńska 164B/30, 30-382 Kraków.

The Store will consider the complaint within 14 days of its receipt and inform the Customer of further steps. In complicated cases, the deadline may be extended to 30 days.

The complaint should include the following information: the Customer's name, surname, and email or correspondence address to which FavPaw should send the response to the complaint, and in the case of a Customer who is an entrepreneur – the company name. Additionally, the order number, name, or description of the advertised Product, a detailed description of the reported reservations, and the solution expected by the Customer should be provided.

FavPaw reserves the right to leave without consideration complaints that do not contain the required data, particularly those preventing the identification of the Customer or establishing contact to clarify the report.

VIII. Personal Data Protection The controller of personal data processed in the Store is Win IT Emil Winiarczyk, with its registered office in Kraków at ul. Kobierzyńska 164B, entered into the Central Registration and Information on Business (CEIDG), NIP: 5641759684, REGON: 384647669.

Personal data is processed for the purpose of order fulfillment, in accordance with applicable data protection laws.

The Customer has the right to access the content of their data, correct them, and request the cessation of their processing.

IX. Copyright Digital Content made available in the Store are works within the meaning of the Act of February 4, 1994, on Copyright and Related Rights and are protected under the provisions of this Act.

Economic copyrights to the Digital Content belong to the owner, Emil Winiarczyk, while moral rights belong to their creators.

All rights to the content made available within the Store, including photos, names, trademarks, graphic elements, software, and databases, are reserved and belong to Emil Winiarczyk or third parties with whom Emil Winiarczyk has concluded appropriate agreements. Legal protection applies to both the Digital Content and other materials available in the Store.

Without the consent of the Store owner, Emil Winiarczyk, it is forbidden to copy, distribute, or otherwise use the materials available in the Store.

Purchased Digital Content may be used by the Customer only for their own use. In particular, the Customer is not allowed to:

• Remove security measures or markings applied to the Digital Content.

• Reproduce or distribute the Digital Content in any form, printed or electronic.

• Share the Digital Content with third parties, both in printed and electronic form.

• Rent or lend the Digital Content in any form.

• Modify or interfere with the content and substance of the Digital Content.

X. Final Provisions The Terms and Conditions come into force on the date of their publication on the Store's website.

FavPaw reserves the right to introduce changes to the Terms and Conditions for important reasons, such as changes in applicable laws or modifications in payment methods, as long as they affect the implementation of the provisions of these Terms and Conditions. FavPaw will inform Customers about any changes at least 7 days before their entry into force.

In matters not regulated by these Terms and Conditions, generally applicable provisions of Polish law apply, in particular, the provisions of the Civil Code, the Act on Providing Services by Electronic Means, the Consumer Rights Act, and the Act on the Protection of Personal Data.
